These Terms of Service (the "Terms") govern your access to and use of the Fix Coffee website at fixcoffee.shop (the "Site") and any purchase you make from us. Fix Coffee is operated by Nav Organic Foods Private Limited, a company incorporated in India with CIN U15100UP2019PTC119293 and GSTIN 09AAGCN6169G1Z3, having its registered office at A-304, Amrapali Awadh, Faizabad Road, Indira Nagar, Lucknow, Uttar Pradesh 226016 ("Fix Coffee", "we", "us", "our").
By using the Site, placing an order, or creating an account, you agree to these Terms. If you do not agree, please do not use the Site. These Terms are an electronic record within the meaning of the Information Technology Act, 2000 and do not require a physical signature.
1. Definitions

"You" means the natural person using the Site or purchasing from us; where a purchase is made by or on behalf of a business, it also means that business.

"Consumer" has the meaning given in Section 2(7) of the Consumer Protection Act, 2019 — a person buying goods for a consideration, other than for resale or commercial use.

"Commercial buyer" means any buyer who is not a Consumer under that definition, including cafés, restaurants, hotels, offices, roasteries, co-working spaces, rentals, and resellers.

"Order" means your offer to purchase the goods listed in your shopping cart at the prices displayed.

"Goods" means the products we sell through the Site.

"Business day" means Monday to Saturday excluding public holidays in Uttar Pradesh.

"Delivery date" means the date on which the courier's tracking shows the parcel as delivered to your address.
- Capitalised terms used but not defined in these Terms have the meanings given in our Refund & Return Policy, Shipping Policy, and Warranty Information.
2. Eligibility
You must be at least 18 years of age and able to enter into a contract under the Indian Contract Act, 1872 to use the Site or place an Order. By placing an Order, you confirm that you meet these requirements and that the information you give us is accurate.
3. Products, descriptions, and images
We describe our products as accurately as we can. Colours, finishes, and textures may vary slightly between monitor displays and the actual product — images are representative, not exact. Packaging, accessory inclusions, and minor cosmetic details can change between production batches of the same SKU without changing the product's fitness for use.
Every imported product we sell carries the country of origin, importer name and address, and month-and-year of import on its product page and invoice, as required under the Legal Metrology (Packaged Commodities) Rules, 2011. If you see a listing missing any of these details, please email support@fixcoffee.in — we will correct the listing within 5 working days.
4. Pricing, taxes, and currency
All prices on the Site are in Indian Rupees (INR) and include applicable GST unless explicitly stated otherwise. Shipping charges (where applicable) are shown at checkout before you confirm your Order. Prices can change without notice; the price that applies to your Order is the price shown on the Site at the time you place the Order.
5. Pricing errors
Occasionally a product may be listed at an incorrect price because of a typographical error, a feed-mapping error, or a system glitch. Where the listed price is clearly incorrect (for example, a ₹45,000 grinder listed at ₹4,500), we reserve the right not to accept the Order at that price. If this happens to your Order, we will contact you before dispatch, offer you the choice of (a) confirming the Order at the corrected price or (b) cancelling the Order for a full refund within 7 working days, and we will act on your choice. We will not unilaterally charge you a higher price than you agreed to pay.
6. Ordering and acceptance
Your Order is an offer by you to buy the Goods. A contract of sale is formed when we accept that offer by dispatching the Goods, as signalled by a shipping confirmation email. Receipt of an order acknowledgement or payment confirmation is not by itself acceptance of your Order.
We may decline to accept an Order only on reasonable grounds, including: (a) the product is out of stock or discontinued; (b) there is a pricing or listing error as described in Section 5; (c) we reasonably suspect the Order is fraudulent, is for resale against our distribution policy, or is placed by someone we have previously terminated service to for breach of these Terms; (d) the delivery address is outside the pincodes we serve; or (e) applicable law prevents us from fulfilling the Order. Where we decline your Order, we will refund any amount you have paid in full, to your original payment method, within 7 working days.
7. Payment
We accept prepaid payment through Razorpay (cards, UPI, net banking, and select wallets) and any other payment methods displayed at checkout. Payment-gateway charges are borne by us, not you. If we cancel or refund an Order on which payment was captured, the gateway charges that Razorpay retains on capture are not refunded to us; the treatment of those charges in your refund is set out in our Refund & Return Policy.
Payment-related chargebacks, disputes, and representments are handled under the rules of your card network, UPI dispute framework, or issuing bank. We will respond to chargeback notices with our ticket records, Failure Analysis Report, and delivery evidence through the gateway's dispute process.
8. Shipping, delivery windows, and title
Full shipping terms — including dispatch windows, delivery windows, compensation for missed windows, pre-orders, force-majeure pauses, and pincode coverage — are set out in our Shipping Policy. Risk of loss or damage in transit passes to you on delivery (not on dispatch). Title in the Goods passes to you on delivery or on receipt of payment in full, whichever is later.
9. Returns, refunds, and cancellations
Full return, refund, and cancellation terms — including the 72-hour DOA window, the Track A (defect) and Track B (change-of-mind) paths, the RMA process, and the appeals ladder — are set out in our Refund & Return Policy.
10. Warranty
Our manufacturer-backed warranty on each product category is set out in the Warranty Information page and the brand-specific warranty pages linked from it. Nothing in these Terms or in our warranty pages excludes, restricts, or limits any non-waivable right you have as a Consumer under the Consumer Protection Act, 2019, the Sale of Goods Act, 1930, or the Legal Metrology Act, 2009 and the rules made under them.
11. Commercial / business use
Our published warranty periods and our Refund & Return Policy are calibrated to home use. If your Order carries a GSTIN belonging to a business engaged in food service, hospitality, office services, co-working, rental, or similar commercial activity, or if the delivery address is a registered commercial establishment, the following applies:
- Warranty cover on products not rated by the manufacturer for commercial duty is reduced to 6 months from the delivery date.
- Consumer-only remedies under the Consumer Protection Act, 2019 do not apply to the transaction, because the buyer is not a Consumer under Section 2(7) of that Act. Remedies under the Sale of Goods Act, 1930 and the Indian Contract Act, 1872 continue to apply.
- Track B (change-of-mind) returns are not available on commercial Orders.
You can flag a personal purchase made under a business GSTIN (for tax convenience) by emailing support@fixcoffee.in within 7 days of the Order. If you do, we will treat the transaction as a personal purchase for warranty and return purposes — but the invoice still shows the GSTIN for your tax records.
12. Intellectual property
The Fix Coffee name, logo, product photography on our Site, collection imagery, editorial copy, and site design are our intellectual property or are licensed to us. You may not copy, reproduce, modify, distribute, or exploit them without our prior written permission, except for personal, non-commercial viewing of the Site. Trademarks and product images owned by third-party manufacturers (for example, HiBrew, MHW-3BOMBER, 1Zpresso, DF) are their property and used with permission or under fair-use conventions of product listing.
13. User content, reviews, and submissions
If you post a product review, a photograph, or any other content through the Site or through a linked channel (for example, a review platform we integrate with), you confirm that the content is your own, does not infringe anyone's rights, and is not false, defamatory, obscene, or unlawful. You grant us a non-exclusive, royalty-free licence to display, reproduce, and excerpt that content in connection with our products — including on product pages, in marketing, and on social media — while the licence lasts for as long as you choose to leave the content up.
We do not pay for reviews, and we do not edit reviews to remove legitimate criticism. We may remove content that we reasonably believe is fraudulent (for example, a review written by a competitor or a bot), defamatory, obscene, or infringing.
14. Prohibited uses
You agree not to use the Site or our services to: (a) break any applicable law; (b) infringe anyone's intellectual property rights; (c) upload or transmit viruses, malware, or other harmful code; (d) attempt to gain unauthorised access to any part of the Site, our systems, or other users' accounts; (e) scrape, crawl, or harvest data from the Site by automated means without our consent; (f) impersonate another person; (g) harass, threaten, or defame anyone through our channels; or (h) resell our products in a way that breaches our distribution policy with our suppliers. If you do any of these things, we may suspend or terminate your account and refuse future Orders.
15. Third-party links and integrations
The Site may link to third-party websites, tools, or services (for example, payment gateways, shipping tracking pages, review platforms). We are not responsible for the content, accuracy, or practices of those third parties. Your use of third-party services is governed by their own terms and privacy policies; please review them.
16. Disclaimer — bounded to lawful scope
The Site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or free from every possible security flaw; we do take reasonable care to keep it working and secure. This disclaimer applies to the Site itself. It does not apply to the Goods you buy from us — Goods are covered by the statutory implied conditions and warranties under the Sale of Goods Act, 1930 (including merchantable quality and fitness for purpose where you have relied on our skill or judgement), the product liability regime under Chapter VI of the Consumer Protection Act, 2019, and the warranty set out in our Warranty Information page. Nothing in these Terms excludes, restricts, or limits those statutory rights, and any clause that purports to do so is read down to the extent required by law.
17. Limitation of liability — bounded to lawful scope
Where permitted by law, our total aggregate liability to you arising out of or in connection with an Order is capped at the amount you paid for that Order. We are not liable for indirect or consequential losses (for example, loss of profit, loss of business opportunity, or loss of goodwill) to the extent those can be excluded by law.
This cap does not apply to: (a) death or personal injury caused by our negligence; (b) product liability under Chapter VI of the Consumer Protection Act, 2019; (c) fraud or fraudulent misrepresentation; (d) any other liability that cannot be excluded or limited under applicable law. In those cases, your rights and remedies are as set out in the relevant statute, without limitation.
18. Indemnification
You agree to indemnify and hold us harmless from any third-party claim, demand, or loss arising out of your breach of these Terms, your violation of any law, or your infringement of any third party's rights. This obligation does not apply to claims that arise out of our own breach, negligence, or unlawful conduct.
19. Force majeure
Neither you nor we are liable for a delay or failure in performance caused by an event beyond the affected party's reasonable control — including floods, earthquakes, severe weather, strikes, civil unrest, government action, court orders, carrier-network outages, pandemic-related restrictions, or similar events. Where a force-majeure event affects our dispatch or delivery, the delivery window pauses for the duration of the event and resumes when the cause has ended. Where it affects your ability to receive delivery, accept a pickup, or ship a return, tell us by email to support@fixcoffee.in within the original window and the clock pauses for the duration of the event.
20. Privacy and data protection
How we collect, use, store, share, and protect your personal data is set out in our Privacy Policy. We process your personal data under the Digital Personal Data Protection Act, 2023 and the rules made under it. Your data-principal rights — including the right to access, correct, erase, and nominate — are described in the Privacy Policy.
21. Grievance redressal
Under Rule 4(5) of the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is:
We acknowledge every grievance within 48 hours of receipt and aim to resolve it within 30 days. If you are not satisfied with the resolution, you may escalate through the appeals ladder set out in our Refund & Return Policy, file a complaint on the National Consumer Helpline at consumerhelpline.gov.in, or approach the District Consumer Disputes Redressal Commission having jurisdiction under Section 34 of the Consumer Protection Act, 2019. Your right to approach a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019 is preserved and cannot be waived by anything in these Terms.
22. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of India. Subject to Section 21, any dispute that is not a consumer dispute under the Consumer Protection Act, 2019 is subject to the exclusive jurisdiction of the courts at Lucknow, Uttar Pradesh. Consumer disputes continue to be governed by Section 34 of the Consumer Protection Act, 2019 — the District Consumer Disputes Redressal Commission within whose territorial jurisdiction you reside, work, or personally carry on business has jurisdiction, and nothing in this section alters that right.
23. Notices
We may send notices to you by email to the address on your Order or account, by WhatsApp to the number on your Order, or by a banner on the Site. You may send notices to us by email to hello@fixcoffee.in or by registered post to our registered office. Formal legal notices must be sent by registered post or courier with proof of delivery to the registered office to be treated as served.
24. Changes to these Terms
We may update these Terms from time to time — for example, to reflect a change in the law, a change in our products, or a change in our operational processes. The updated Terms take effect from the date they are published. For material changes, we will also announce the update on the Site or by email. Your continued use of the Site or placement of a new Order after the update constitutes acceptance of the updated Terms. Orders placed before an update are governed by the Terms in force at the time of that Order.
25. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect, and the invalid provision is read down to the minimum extent necessary to make it enforceable. These Terms, together with the policies they reference, form the entire agreement between you and us with respect to your use of the Site and your purchase of Goods from us, and supersede any prior agreement or understanding on the same subject matter.
